On Nov 4, 2021, the Biden-Harris Administration issued an emergency order 415.51(c) by the Centers for Medicare and Medicaid Services (CMS) requiring all healthcare workers in a variety of healthcare facilities such as hospitals, ambulatory care centers, nursing homes, and many other healthcare settings to be fully vaccinated against COVID-19. CMS has mandated COVID-19 vaccines on every full-time employee, part-time employee, volunteer, and contractor working at a wide range of healthcare facilities receiving Medicare or Medicaid funding. This federal mandate affects every CMS licensed healthcare facility and provider in the United States. This mandate was upheld by the Supreme Court on January 13, 2022.
This federal mandate requires all health care employees to have the first of a two-dose vaccine, or a single dose vaccine by February 14, 2022, and be fully vaccinated by March 15, 2022. The booster is not required. This applies to all employees regardless of clinical responsibility or patient contact. The mandate is very specific and does not allow for weekly testing in place of the vaccine. The only exemptions are based on recognized medical conditions and religious beliefs and must be secured by the CMS mandate deadline. The exemption forms are available below.
